Terms and Conditions

These terms and conditions ("Terms") govern your use of propertytitlecheck.co.uk (the "Site") and the document ordering service (the "Service") provided by Spirit Vanguard ("we", "us", "our"), a company registered in Scotland under company number SC780978, with its registered office at 70 Victoria Road, Aberdeen, Scotland, AB11 9DS

By using the Site or placing an order, you agree to these Terms. Please read them carefully before ordering.

1. Who we are

We are an independent company. We are not HM Land Registry, we are not part of any government department, and we are not endorsed by or affiliated with HM Land Registry or any other government body. We provide a paid service that submits document requests to HM Land Registry on your behalf and delivers the results to you.

Documents such as the title register and title plan are available to order directly from HM Land Registry at www.gov.uk at the government's own fee. Our fee is higher than this because it includes the work, we do to verify the correct property and plot, place and manage the order, and deliver the document to you securely — see clause 6.

2. The Service

2.1 You search for a property by postcode, select the correct address, and confirm the plot shown against the HM Land Registry INSPIRE index before ordering.

2.2 The plot boundary shown on the Site is illustrative only, based on HM Land Registry's index data. It shows the general position and extent of a registered title and is not a precise legal boundary. Only the title register and title plan for a specific title can establish the registered extent of a property.

2.3 Once you place an order, we submit a request for the relevant official document(s) to HM Land Registry on your behalf. This is currently a manual process carried out by our staff.

2.4 We aim to deliver documents within 3 working days of your order, but times may vary depending on HM Land Registry's own processing times, which are outside our control.

2.5 Documents are delivered by email as a secure, time-limited download link. We do not post physical copies.

3. Eligibility and your account

3.1 You must be at least 18 years old to use the Service.

3.2 You are responsible for providing accurate information when placing an order, including the correct postcode, address, and confirmation of the correct plot. We are not responsible for ordering the wrong document if you confirm an incorrect property.

4. Pricing and payment

4.1 All prices are shown in pounds sterling and are inclusive of any applicable VAT unless stated otherwise.

4.2 The price shown at checkout is the total amount you will pay and includes both the government fee payable to HM Land Registry for the document (currently £7 per document) and our service fee for locating, verifying, ordering, and delivering it to you.

4.3 Payment is taken in full at the time of order via our secure payment provider. We do not store your full card details.

4.4 Prices may change from time to time, but changes will not affect orders you have already placed.

5. Your right to cancel

5.1 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you normally have 14 days to cancel an online order for a full refund.

5.2 Because our Service involves us beginning work on your order immediately — submitting your request to HM Land Registry — we ask you to expressly agree, at the point of ordering, that we may begin performing the Service straight away. Once you have given this consent and we have submitted your order, you acknowledge that you lose your right to cancel under the Regulations, in line with regulation 36–37 of the Consumer Contracts Regulations 2013.

5.3 If you cancel before we have submitted your order to HM Land Registry, you are entitled to a full refund.

6. Refunds

6.1 Because documents are supplied by HM Land Registry based on the property details you confirm, we are unable to offer refunds once a document has been successfully ordered and delivered, except as set out below.

6.2 You are entitled to a full refund if we are unable to obtain the requested document through no fault of yours, or there is a verified technical fault that prevents you accessing the document you ordered.

6.3 If you provided incorrect property details and we ordered the wrong document as a result, we are not obliged to provide a refund, but we may offer to reorder the correct document at a reduced fee at our discretion.

7. Accuracy of documents

7.1 Documents supplied through the Service are official copies issued by HM Land Registry. We are not responsible for the accuracy, completeness, or currency of the underlying register data — this is maintained solely by HM Land Registry.

7.2 Our responsibility is limited to accurately submitting your order and delivering to you the document HM Land Registry provides in response.

8. Liability

8.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited under English law.

8.2 Subject to clause 8.1, our total liability to you for any claim arising from your order is limited to the amount you paid for that order.

8.3 We are not liable for indirect or consequential losses, including loss arising from your reliance on document content for legal or financial decisions — we recommend seeking professional (e.g. conveyancing or legal) advice for any transaction that depends on the content of these documents.

9. Use of documents

9.1 Documents are provided for your personal or professional use. You must not resell, sublicense, or redistribute the documents, or the underlying HM Land Registry or Ordnance Survey data, as a standalone product without the appropriate licence.

9.2 Plot boundary data displayed on the Site is derived from HM Land Registry's INSPIRE Index Polygons, licensed under the Open Government Licence v3.0, and incorporates Ordnance Survey data © Crown copyright.

10. Prohibited use

You must not use the Site to submit fraudulent orders, attempt to access another person's order or documents, interfere with the operation of the Site, or use automated means to extract data from the Site.

11. Complaints

If you are unhappy with the Service, please contact us at support@propertytitlecheck.co.uk in the first instance. We aim to respond to all complaints within 3 working days.

12. Data protection

Our use of your personal data is set out in our Privacy Policy, which forms part of these Terms.

13. Changes to these Terms

We may update these Terms from time to time. The version in force at the time you place an order will apply to that order.

14. Governing law

These Terms are governed by the laws of England and Wales. Any disputes are subject to the exclusive jurisdiction of the courts of England and Wales, save that if you live in Scotland or Northern Ireland you may also bring proceedings in your local courts.
